Terms of service
Last Updated: September 14, 2026
These Terms of Service govern your access to and use of the FONETO Marine website, including any product information, inquiry forms, quotation services, and related content made available through this website.
By accessing or using this website, submitting an inquiry, requesting a quotation, or otherwise communicating with FONETO Marine through this website, you agree to these Terms of Service. If you do not agree with these terms, please do not use the website.
1. Business Use
This website is primarily intended for distributors, importers, repair networks, marine dealers, boat builders, OEM customers, and other professional or commercial users.
If you use this website on behalf of a company or other organization, you confirm that you are authorized to act on its behalf.
2. Contracting Party
“FONETO,” “FONETO Marine,” “we,” “us,” and “our” refer to the FONETO business operating this website. For any commercial order, the legal contracting seller will be the entity identified in the applicable quotation, pro forma invoice, sales contract, or order confirmation.
3. Website Information
The website is provided for product presentation, technical reference, product matching, and business inquiry purposes.
Product descriptions, photographs, dimensions, materials, engine applications, horsepower ranges, spline information, OEM references, and other specifications are provided for general reference. We make reasonable efforts to keep this information accurate, but specifications and product availability may be updated without prior notice.
Product photographs are illustrative. Minor differences in color, surface finish, packaging, markings, or manufacturing details may occur.
4. OEM References and Third-Party Trademarks
OEM numbers, engine manufacturer names, model names, and third-party trademarks displayed on this website are used solely for product identification, compatibility reference, and comparison purposes.
Unless expressly stated otherwise, FONETO replacement products are not manufactured, sponsored, endorsed, or authorized by the referenced original equipment manufacturers.
5. Product Compatibility and Fitment
Customers are responsible for confirming that a product is suitable for the intended engine, gearcase, vessel, installation, and operating conditions before placing an order.
For accurate product matching, customers should provide all available information, including engine brand, engine model, horsepower, production year, current propeller dimensions, spline count, rotation, gearcase size, OEM reference, and relevant photographs.
Product-matching assistance provided by FONETO is based on the information supplied by the customer. Incomplete or inaccurate information may result in an unsuitable recommendation. A recommendation does not replace proper installation, inspection, or professional technical judgment.
6. Inquiries, Quotations, and Orders
Submitting an inquiry or quotation request through this website does not create an order or require either party to complete a transaction.
Website content, product listings, and product availability do not constitute a binding offer. Prices, minimum order quantities, production lead times, payment terms, packaging, shipping terms, and other commercial conditions will be confirmed separately in writing.
An order becomes binding only after FONETO issues written acceptance, a confirmed quotation, pro forma invoice, sales contract, or order confirmation and receives any required deposit or payment.
If these Terms of Service conflict with an accepted quotation, pro forma invoice, sales contract, or written order confirmation, the terms of the applicable commercial document will take priority.
7. Prices, Taxes, and Charges
Product prices are generally provided by quotation and may depend on specifications, materials, quantity, packaging, tooling, branding, destination, and market conditions.
Unless expressly stated otherwise, quoted prices exclude freight, insurance, customs duties, import taxes, value-added tax, sales tax, bank fees, inspection fees, certification costs, and other destination-related charges.
The customer is responsible for taxes, duties, customs procedures, import permits, and other charges applicable in the destination country unless otherwise agreed in writing.
8. Payment
Payment currency, deposit requirements, balance-payment deadlines, bank details, and payment methods will be specified in the applicable quotation, pro forma invoice, sales contract, or order confirmation.
The customer is responsible for bank charges unless otherwise agreed. Production may be delayed until cleared funds and all required approvals have been received.
FONETO may suspend production, shipment, or further performance if an agreed payment is overdue.
9. Minimum Order Quantities and Samples
Minimum order quantities may apply and will be confirmed during quotation.
Samples may differ from final production goods where different tooling, manufacturing batches, finishes, packaging, or approved production specifications are used. Sample fees and shipping charges are non-refundable unless otherwise agreed in writing.
10. OEM, Private-Label, and Custom Products
OEM, private-label, custom-branded, custom-packaged, and specially manufactured products are produced according to specifications approved by the customer.
The customer is responsible for reviewing and approving drawings, dimensions, samples, artwork, trademarks, packaging information, labels, and other production details before manufacturing begins.
The customer confirms that it has the right to use any trademarks, logos, artwork, technical files, or other materials supplied to FONETO. The customer is responsible for claims arising from unauthorized materials supplied by the customer.
Reasonable manufacturing tolerances and minor production variations may apply unless specific tolerances are agreed in writing.
11. Order Changes and Cancellation
Any request to change or cancel an accepted order must be submitted in writing and is subject to FONETO’s written approval.
Once materials have been purchased, tooling has begun, artwork has been approved, or production has started, deposits, tooling charges, customization costs, and other incurred expenses may be non-refundable.
Custom, OEM, and private-label goods cannot normally be cancelled or returned except where a verified manufacturing defect or material non-conformity exists.
12. Production and Lead Times
Production and delivery dates are estimates unless expressly guaranteed in writing.
Lead time normally begins after receipt of the required deposit, final technical confirmation, artwork approval, sample approval, and all other information required for production.
FONETO is not responsible for delays caused by incomplete customer information, approval delays, payment delays, carrier delays, customs procedures, port congestion, material shortages, or events beyond our reasonable control.
13. Shipping, Risk, and Title
Shipping method, delivery location, freight responsibility, transfer of risk, and applicable Incoterms will be stated in the quotation, pro forma invoice, sales contract, or order confirmation.
Where Incoterms are used, they refer to the current applicable version of the Incoterms rules unless another version is specified.
The customer is responsible for checking shipment details and providing complete and accurate consignee, customs, and delivery information.
14. Inspection and Claims
Customers should inspect shipments promptly after receipt. Visible damage, shortages, incorrect quantities, or apparent non-conformity should be reported in writing within seven business days after delivery unless another period is specified in the applicable commercial documents.
Claims must include the order or invoice number, affected product number, quantity, photographs, packaging photographs, and a clear description of the issue.
Transport damage should also be reported promptly to the carrier. Products must not be returned without prior written authorization from FONETO.
15. Warranty and Remedies
Any applicable product warranty will be stated in the relevant quotation, pro forma invoice, sales contract, order confirmation, or written warranty document.
Warranty coverage does not apply to normal wear, corrosion caused by improper use, incorrect installation, impact damage, cavitation, overloading, racing, unauthorized modification, improper storage, unsuitable application, or failure to follow installation and maintenance requirements.
For a verified defect covered by an applicable warranty, FONETO may, as appropriate, repair the product, replace the affected product, issue a credit, or provide another commercially reasonable remedy.
16. Limitation of Liability
To the fullest extent permitted by applicable law, FONETO will not be liable for indirect, incidental, special, punitive, or consequential losses, including loss of profit, loss of revenue, business interruption, loss of use, or loss of opportunity.
To the fullest extent permitted by applicable law, FONETO’s total liability relating to an affected product or order will not exceed the amount paid to FONETO for the specific affected goods giving rise to the claim.
Nothing in these terms excludes liability that cannot legally be excluded or limited.
17. Intellectual Property
Unless otherwise stated, website text, graphics, logos, photographs, layouts, product presentations, downloadable materials, and other original content are owned by or licensed to FONETO.
You may not reproduce, republish, distribute, modify, scrape, commercially exploit, or create derivative works from website content without prior written permission.
18. Prohibited Use
You may not use this website to violate applicable law, infringe intellectual-property rights, submit false information, transmit malicious software, interfere with website security, attempt unauthorized access, or collect website data through abusive automated methods.
We may restrict access to the website where misuse, fraud, security risks, or unlawful activity are suspected.
19. Third-Party Services and Links
The website may use or link to services operated by third parties, including Shopify, payment providers, analytics providers, carriers, social networks, and external websites.
FONETO does not control and is not responsible for the content, availability, security, or policies of third-party services. Use of those services may be subject to separate terms and privacy policies.
20. Privacy
Personal information submitted through this website is handled according to our Privacy Policy. By submitting an inquiry, you authorize us to use the information provided to respond, prepare quotations, perform product matching, and communicate about potential or existing business.
21. Force Majeure
FONETO will not be responsible for delay or failure caused by circumstances beyond reasonable control, including natural disasters, fire, flood, epidemic, war, civil disturbance, government action, sanctions, labor disputes, power interruption, cyber incidents, material shortages, transportation disruption, port congestion, or carrier failure.
22. Governing Terms and Disputes
The governing law, jurisdiction, arbitration terms, or dispute-resolution procedure stated in an applicable quotation, pro forma invoice, sales contract, or order confirmation will apply to the related transaction.
Where no separate provision has been agreed, the parties will first attempt to resolve any dispute through good-faith negotiation. The governing law and competent forum will be those applicable to the registered jurisdiction of the contracting seller identified in the commercial documents.
23. Changes to These Terms
We may update these Terms of Service when our website, products, business practices, or legal requirements change. The revised version becomes effective when published on this website. The “Last Updated” date will identify the latest revision.
